(Daily Paul) After thinking about it for some time, I have decided to share my true story with you, in the hope that maybe even a few can be convinced of the absolute tyrannical state of our government and the absolute necessity of fighting to keep our 2nd Amendment rights at all costs.
What I am about to tell you is the truth. I am not twisting the facts in any way or changing any names to protect the innocent (whoever they may be).
In 1999, I ran a successful business with my father and brother. My dad came across some information that literally shattered my beliefs about the rule of law in this country and literally changed my life forever. He came across a man named Irwin Schiff (yes, Peter Schiff’s dad…who is now in federal prison because he was not allowed to bring up the law in his defense) who had written a book (The Federal Mafia…which is now banned…so much for the 1st Amendment) unequivocally stating that the Income Tax, as it was being imposed was a fraud. He asserted that the 16th Amendment did NOT give the federal government the authority to directly tax a person’s wages and that because of this, the term “income” as used in the 16th Amendment was not defined in the Internal Revenue Code, nor was there any liability section ever created for Income Taxes in the IRC stating who exactly is required to pay the tax (as there is for EVERY other tax in the IRC). I was literally shocked by this information, as was my dad. If it was true, the federal government was getting away with one of the greatest hoaxes in American history. How could this be true in America…the Land of the Free and the Home of the Brave?
For the next year I studied, and I studied and read court cases and statutes and regulations trying to get to the bottom of it, and ultimately I came to the conclusion that Irwin Schiff was correct. There is no law requiring anybody to pay the income tax (no liability section) and income as used in the 16th Amendment has a very different legal definition than what the American people had been led to believe. I cried…I literally did, at the discovery that the American people had literally been enslaved, and most did not even realize it, me included!! If they can lay claim to 30% of your hard earned money…why not 40%?…why not 50%?…why not all of it? How can any person ever define themselves as being free, while another can lay claim to the fruits of their labor? The plain truth is, they can not.
After much agonizing debate and discussion, my dad, myself and my brother mustered up all of the courage that we could find and we decided to challenge the income tax head on. I live in Mass. and because they have adopted the federal code (i.e. whatever income means on the federal level, it also means in Mass.) it was necessary to challenge it both on the state and federal levels.
I want to say first, that I never hid anything that I was doing from anybody (I was extremely naive). We had an S-Corp and the Corporation continued to file yearly Corporate Returns and paid all of the legitimate taxes that were assessed against it (i.e. excise and sales taxes); however, we filed our personal returns showing zero “16th Amendment Income” with an attachment detailing why we believed we had zero “16th Amendment Income”, including all of the relevant case law, and asking for further clarification and explanation if our interpretation was incorrect. Basically, we just asked them to defined the term “income” as used in the 16th Amendment (because it is not defined in the IRC), tell us where we could find the liability section for income in the IRC and show us the law requiring us to pay taxes on our wages!
That was the beginning of a firestorm that has changed my life forever. We had bank accounts seized, properties attached and credit lines revoked all for simply asking them to show us the law! Even the IRS has guidelines which state that they are required to give you a due process hearing upon request PRIOR to collection activity, as does the state; however, we found out that apparently their own rules and regulations are optional for them. Regardless, we stayed the course for six long years, fighting back unlawful bank seizures and property levies, going to hearing after hearing and never once were our questions ever answered. I cannot count at this point the thousands of hours I devoted to this because I believed (and still do) that what I was asserting was true. I had lawyers and people in government (off the record) tell me that “technically” we were correct, but it did not matter, we were going to lose anyway!
Going to the IRS appeals hearings were literally a joke, albeit not a funny one. At one hearing, we waited for hours and then finally had a feeble woman come out and sit at the table with us who refused to answer a single question or provide us with any of the information we requested. She silently sat there while we presented our case to her and never once attempted to answer any of our questions (honestly, I don’t think she had a clue how to answer them). Afterward, she told us we would be notified in writing of the result of our hearing. And of course it was the same old stock answer “the courts have ruled that challenging the income tax is frivolous” (ie: Resistance is Futile), and their responses never, ever provided specific answers to the questions that we had asked. Not once.
We took our fight with the state all the way to the Appellate Tax Board, with the same results… questions never answered, same old stock non-answers always provided with a level of arrogance that rivals any King. Subjects are not allowed to question their King you silly girl!
In 2005, I lost my final appeal to the Mass. appellate tax board and had filed my notice of appeal with the state, when my dad was diagnosed with Stage 4 Liver Cancer and given less than six months to live. I was devastated by the loss of my dad and that was it for me….I couldn’t fight them anymore. I was broke, our company had failed without access to credit lines and I just couldn’t do it, not alone. My brother had already given up and moved out west.
A peculiar thing happened with the IRS though; my final appeal with them was returned to me in it’s entirety with a copy of my master IMF file showing zero taxes due. There was an angel at the agency who zeroed out my account, no name provided, no explanation given. I was glad for it.
The state; however, has turned what would have been a $20,000 +/- tax liability into a $275,000 tax liability with their absurd penalties and interest. Talk about usury…that is more than 1000 times what the original liability would have been. It may as well be $2,000,000 at this point, because it is more than I can ever repay, nor would I ever be willing to give them that amount of money even if I could. At one point, I filed another appeal challenging the amount of penalties and interest they have added and they denied my appeal request. I simply do not have the funds to fight them in court, nor do I have any confidence of the rigged system ruling in my favor if I did.
They have now revoked my license to drive indefinitely because of the “alleged” unpaid taxes. I can not “legally” drive; however, I do what I need to do. Those who are not willing to act as a free people, regardless of what they say, will never be a free people. I have tried for two years to find a job and figure I will find a way to get there once I get it; however, I have been unsuccessful to date. I don’t know this for sure, but I know that many companies do credit checks and I think that a $275,000 tax liability on my credit report is not conducive to finding work.
I attempted to get a “hardship” license but I was told by the RMV that there is nothing they can do. Apparently “hardship” licenses are available only to drunk drivers and not tax challengers.
This whole event is what opened my eyes to not only the fact that we no longer live under the rule of law in this country, but even worse, that we are being governed by criminals who care nothing about the oaths that they took and even less about the lives that they destroy. More often then not these days, I am angry. I am angry at what has happened to my country. I am angry by the manner in which my life was destroyed for simply asking that the Constitution and our laws be followed. I am angry that too many people turn a blind eye to the corruption and chaos that has engulfed our once great nation. I am angry and devastated by the fact that our children are going to live under a system of tyranny that is exactly the opposite of what our founding fathers fought and died to leave for us. I am so sad that there is a very real possibility that the generations to come will have no idea or concept of what true freedom really is….if understood at all, it will be nothing more than a myth or an unattainable dream. It is only my faith in God and the love of my children that keep me going and fighting most days. I have lose everything else, but really, they are all that matters anyway.
So why should you care, some of you may be thinking? You pay your taxes and you live just fine, for now anyway. Pay your taxes and you won’t have a problem..right? Wrong! No one is safe when you have a government that turns a blind eye to the rule of law. No one. And with Obamacare recently being passed, I can see crystal clear where this is headed. Despite Justice Roberts disingenuous and absurd ruling, the IRS does have teeth to enforce Obamacare. They have sufficient teeth at this point to enforce anything that they want to, who is going to stop them….you? Get the healthcare or pay the fine or they will destroy you. Period. Just ask Irwin Schiff. Just ask the thousands of other people who have been victimized by that despicable agency and a government gone rogue. Just ask me.
Mark my words, it is going to get to the point where many, many people simply will not be ABLE to comply with the requirement, simply because they won’t have the funds to do so, but at the same time, they won’t earn a small enough amount to qualify for the “free to me” healthcare (not to mention those of us who quite simply don’t want “free to me” healthcare). Despite the lies that the media force fed us, this legislation will not result in decreased premiums. It is going to result in increased premiums because the insurance companies now know you don’t have a choice but to pay them. That is EXACTLY why the insurance companies pushed for this legislation and it is EXACTLY what happened in Massachusetts and is EXACTLY what is going to happen nationwide. This legislation is going to completely decimate our middle class. I would bet my life on it. It now costs anywhere from $1,200 – $1,500 per month for a family health plan in Massachusetts, and what they are required to cover gets smaller and smaller every year. How many of you have room in your budget for an extra $1,200 – $1,500 per month, not including the extra payments you will have to make for all the stuff the insurance companies no longer will cover?
So, a lot of people are going to have their hours cut back, so that their companies don’t have to provide the insurance (those that don’t lose their jobs all together); however, they are still going to be required to have insurance, at an ever increasing price, or face an IRS penalty, which is sure to increase and increase (and the insane interest) and the levies and hardship that will accompany your failure to comply. Ultimately, they will levy bank accounts, lien properties and revoke driver’s licenses, just as they do in Mass. if you do not pay your penalties and many more lives will be destroyed. As Massachusetts goes, so goes the nation. We are the testing ground. Soon, many, many more are going to be very much awake and very angry…just like me.
So, why do you think they want our guns? Angry people with guns is never good news for rogue governments. The door is closing on freedom in America and the 2nd Amendment is our last foot in the door. As stated by so many before, the 2nd Amendment is the only means to protect the other 9, when all else fails. Without it, any hope of restoring liberty to this country is lost…possibly forever. If this government can do what it’s done to an armed populace, can you imagine what it is capable of doing to an unarmed populace? Are you really willing to find out? Do you really think that a government that is willing to enslave it’s entire population through deception really cares about whether or not a “lone gunman” goes crazy and kills some people? Believe me when I tell you that they could care less about any of us getting shot…their only real concern is that we finally become angry enough to collectively turn our guns on them…and the clock is ticking. Things are about to get really bad, really soon in this country and our guns are our last, best hope of surviving it and having any control over what rises out of the ashes. We lose our guns and liberties’ dim light will finally go out with them.
